Christopher's Genie Terms of Service

1. Introduction and Acceptance

Welcome to Christopher's Genie ("the Game"), a free-to-play mobile match-3 puzzle game based on the YouTube series Christopher's Genie. The Game is developed and published by GMI Partners Inc., operating as GMI Studios ("we," "us," or "our"), located at 400 - 22 E 5th Ave, Vancouver, BC, Canada V5T 1G8.

These Terms of Service ("Terms") govern your access to and use of Christopher's Genie, including all features, content, in-app purchases, and related services (collectively, the "Service"). By downloading, installing, or using the Game, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and Age Requirements

Christopher's Genie is rated 9+ on the Apple App Store and is designed for a broad audience, including younger players.

2.1 Players Under 13

If you are under 13 years of age, you must have your parent or legal guardian review and accept these Terms on your behalf before you use the Game. Your parent or guardian is responsible for your use of the Service and any purchases made through their device. We comply with the Children's Online Privacy Protection Act (COPPA), the Canadian Personal Information Protection and Electronic Documents Act (PIPEDA), and equivalent child protection laws. Please see our Privacy Policy for details on how we handle children's data.

2.2 Players Aged 13-17

If you are between 13 and 17 years old, we recommend you review these Terms with a parent or guardian. You represent that you have their permission to use the Service.

2.3 Parental Responsibility

Parents and guardians are responsible for monitoring their child's use of the Game, including managing in-app purchases through the parental control features provided by Apple (Screen Time) and Google (Family Link). If you believe a child has used the Service without proper consent, please contact us immediately at support@gmistudios.io.

3. The Service

Christopher's Genie is a match-3 puzzle game in which players defeat the evil Malik, break jars, and collect genies from the YouTube series. The Service includes:

• Core match-3 puzzle gameplay with strategic planning mechanics
• Collection of 60+ genie characters across multiple types (Breakers, Blasters, Tricksters, Summoners), including rare Shiny variants
• Competitive leaderboards (the "Blob League") with global rankings
• Guild system for team play, cooperative features, and life-sharing between members
• User-created levels and custom content
• Weekly new levels, live events, and seasonal content updates
• Daily login rewards (every 12 hours) and win streak bonuses
• Push notifications for game events, rewards, and updates (which you may disable at any time through your device settings)

We reserve the right to modify, update, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to provide advance notice of significant changes.

4. Accounts and Authentication

You may access the Game as a guest or by linking your account through one of the following authentication providers:

• Sign in with Apple - uses your Apple ID; you may choose to share or hide your email address
• Google Play Games - uses your Google Play Games player ID for authentication and achievements

When you sign in, we receive a limited authentication token and, depending on the provider, your name and email address. We do not receive or store your Apple or Google password. See our Privacy Policy for details on what data each provider shares with us.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@gmistudios.io if you suspect unauthorized access.

5. In-App Purchases and Virtual Items

5.1 Virtual Currency and Items

The Game offers optional in-app purchases, including virtual currency ("Gold"), Premium Season Keys, and promotional bundles, with prices ranging from CAD $2.99 to CAD $159.99. All virtual items:

• Are licensed to you, not sold, and remain the property of GMI Studios
• Have no real-world monetary value and cannot be exchanged for real currency
• Are non-transferable between accounts or players
• May be modified, rebalanced, or removed at our discretion as part of game updates, including changes to character abilities, stats, visual appearance, or gameplay behavior

You acknowledge that when you acquire a virtual item, whether through purchase, gameplay, or randomized reward, you are obtaining a license to access that item in its current or future form, not a guarantee that the item will retain any specific attributes, abilities, power level, or design. We regularly update the Game to improve balance, fix issues, and keep gameplay fair and enjoyable, and these updates may affect any virtual item, character, or genie you have obtained. No modification, rebalancing, or reworking of a virtual item entitles you to a refund, exchange, or compensation.

Virtual items have no stored value as defined under any applicable law, including California Civil Code Section 1749.5 or any equivalent statute. Virtual items are not redeemable for cash, are not deposits, and do not constitute personal property. Upon purchase, the risk of loss for all virtual items passes to you.

5.2 Randomized Purchases (Loot Boxes)

The Game contains randomized reward mechanics where certain items or characters are obtained through chance-based systems (for example, character packs where the specific genie received is determined by chance). Before engaging with any randomized purchase:

• You will be informed of the general categories of items available and approximate rarity tiers
• You acknowledge that specific outcomes are determined by chance and no particular item is guaranteed
• You acknowledge that items obtained through randomized purchases are subject to the same rebalancing and modification rights described in Section 5.1
• Parents should be aware that the Game's App Store listing discloses "Contains Loot Boxes"

For players in jurisdictions that require specific loot box probability disclosures (including Belgium, the Netherlands, and certain other regions), we will provide the applicable odds information within the Game or upon request.

5.3 Purchases and Refunds

All purchases are processed through the Apple App Store or Google Play Store. GMI Studios does not directly collect or store your payment card information. Refund requests must be directed to the applicable platform:

5.4 Loss of Virtual Items

If your account is suspended or terminated for violation of these Terms, you may lose access to all virtual items and currency without compensation or refund.

6. User-Created Content

6.1 What You Can Create

The Game allows you to create and share content, including custom levels, usernames, and profile information (collectively, "User Content").

6.2 License You Grant Us

By submitting User Content, you grant GMI Studios a perpetual, irrevocable, non-exclusive, royalty-free, worldwide, fully sublicensable license to use, display, reproduce, modify, adapt, publish, and distribute your User Content in any media, within the Service and for promotional purposes related to the Game.

To the fullest extent permitted by applicable law, you waive any moral rights (including rights of attribution and integrity) in your User Content, or if such waiver is not permitted, you agree not to assert such rights against GMI Studios. You acknowledge that you will not receive any compensation for your User Content and that GMI Studios is under no obligation to use it.

6.3 Feedback and Suggestions

If you provide GMI Studios with any feedback, suggestions, ideas, or proposals regarding the Game ("Feedback"), you assign all right, title, and interest in such Feedback to GMI Studios. We are free to use Feedback for any purpose without compensation or obligation to you. No Feedback will be considered confidential or proprietary.

6.4 Content Standards

You represent and warrant that your User Content:

• Is your original creation or you have the necessary rights to share it
• Does not infringe any third party's intellectual property or privacy rights
• Does not contain offensive, abusive, hateful, sexually explicit, defamatory, or illegal material
• Is appropriate for the Game's 9+ age rating and the broad audience that includes children
• Does not contain personal information of any third party (especially minors)

We reserve the right to review, moderate, and remove any User Content at our sole discretion, without notice.

7. Rules of Conduct

When using the Service, you agree not to:

• Use cheats, exploits, automation software, bots, hacks, or unauthorized third-party tools to gain an unfair advantage
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of any part of the Game
• Interfere with, disrupt, or place an unreasonable burden on the Service or its infrastructure
• Harass, threaten, bully, or use offensive or hateful language toward other players in any in-game feature
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorized access to other accounts, the Game's servers, databases, or related systems
• Buy, sell, trade, or transfer accounts or virtual items outside the Game for real money or other value
• Manipulate leaderboard rankings, guild systems, or matchmaking through exploits or coordinated abuse
• Use the Service for any unlawful purpose or in violation of any applicable laws

We reserve the right to monitor, analyze, and review gameplay data and user activity using automated tools, analytics, and manual review to detect, investigate, and enforce compliance with these rules. This includes identifying cheating, exploitation of game mechanics, abusive behavior, and coordinated manipulation of game systems.

8. Intellectual Property

All content in Christopher's Genie, including artwork, character designs, genie illustrations, music, sound effects, game mechanics, text, user interface elements, and underlying software, is the property of GMI Studios or its licensors and is protected by copyright, trademark, and other intellectual property laws. The Christopher's Genie brand, characters, and story elements originate from the YouTube series and are owned by or licensed to GMI Studios.

Your use of the Service grants you a limited, non-exclusive, non-transferable, revocable license to use the Game for personal, non-commercial purposes. You may not copy, distribute, modify, publicly display, or create derivative works from any part of the Game without our prior written consent.

8.1 Copyright Infringement Claims (DMCA)

If you believe that content available through the Service infringes your copyright, you may submit a notice to our designated agent with the following information: (a) a description of the copyrighted work you claim has been infringed; (b) a description of the allegedly infringing material and its location within the Service; (c) your contact information (name, address, email, phone); (d) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; (e) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf; and (f) your physical or electronic signature.

Send DMCA notices to support@gmistudios.io with the subject line "DMCA Notice." We will respond to valid notices in accordance with applicable law and may remove or disable access to allegedly infringing content.

9. Guilds, Leaderboards, and Social Features

The Game includes social features such as guilds, the Blob League leaderboard, life-sharing, and the ability to share achievements externally. By participating in these features:

• Your username, scores, rankings, guild membership, and gameplay statistics may be visible to other players
• Guild members may see your activity status, contributions, and life requests
• Leaderboard data is ranked globally and displayed publicly within the Game
• You agree to conduct yourself respectfully when interacting with other players
• We may moderate, restrict, or remove access to social features for players who violate these Terms

10. Referral and Invite System

The Game includes an invite system that allows you to share referral links with friends. When you share an invite link, certain metadata (such as your friend code and invite identifier) is transmitted through our attribution partner, AppsFlyer, to track successful referrals. By using the invite feature, you consent to this data processing. You agree not to abuse the referral system through fake accounts, automated sharing, or other fraudulent means.

11. Push Notifications

With your consent, the Game may send push notifications about events, rewards, updates, and other game-related information. You may disable push notifications at any time through your device's settings. Your push notification token is stored securely and used solely for delivering game-related messages through Apple Push Notification Service (APNs) or Firebase Cloud Messaging (FCM).

12. Suspension and Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms. Upon termination:

• Your license to use the Service is immediately revoked
• You may lose access to your account, progress, virtual items, user-created levels, and all associated data
• No refunds or compensation will be provided for lost items, currency, or progress

You may terminate your use at any time by uninstalling the Game. To request full account deletion (including server-side data), contact support@gmistudios.io. We will process account deletion requests in accordance with applicable privacy laws.

12.1 Inactive Accounts

If your account remains inactive (no gameplay or login activity) for a continuous period of twelve (12) months, we may delete your account and all associated data, including virtual items, game progress, and User Content, without notice or compensation. We encourage you to log in periodically to keep your account active.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GMI STUDIOS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF VIRTUAL ITEMS, OR INTERRUPTION OF SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU HAVE PAID TO US THROUGH IN-APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY CANADIAN DOLLARS (CAD $50).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY LIABILITY THAT CANNOT BE EXCLUDED BY LAW.

14.1 Force Majeure

GMI Studios shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, government actions or regulations, power or internet outages, failures of third-party hosting or cloud services (including AWS), cyberattacks, or labor disputes. During any such event, our obligations under these Terms are suspended for the duration of the event.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless GMI Studios, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your User Content, or (d) your violation of any applicable law or third-party rights.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@gmistudios.io. If we are unable to resolve the dispute within thirty (30) days, either party may commence formal proceedings.

Any disputes not resolved informally shall be brought before the courts located in Vancouver, British Columbia, Canada, and you consent to the exclusive jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to prevent imminent harm.

16.1 Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND GMI STUDIOS AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST GMI STUDIOS. If this class action waiver is found to be unenforceable in your jurisdiction, then this entire dispute resolution section (except for the informal resolution requirement) shall be void, and disputes shall be decided by a court of competent jurisdiction.

16.2 Jury Trial Waiver

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND GMI STUDIOS EACH WAIVE THE RIGHT TO A JURY TRIAL FOR ANY DISPUTE ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.

16.3 Time Limitation on Claims

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION AROSE, OR IT SHALL BE PERMANENTLY BARRED. This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise.

17. Platform-Specific Terms

Your use of the Game is also subject to the terms and conditions of the platform from which you downloaded it:

• Apple App Store: Apple's Licensed Application End User License Agreement applies. Apple has no obligation to provide maintenance or support for the Game. In the event of any conflict between these Terms and Apple's terms regarding in-app purchases or refunds, Apple's terms prevail for those matters.
• Google Play Store: Google Play's Terms of Service apply. Google has no obligation to provide maintenance or support for the Game. In the event of any conflict between these Terms and Google's terms regarding purchases or refunds, Google's terms prevail for those matters.

Apple and Google are third-party beneficiaries of these Terms solely with respect to the platform-specific provisions, and each has the right to enforce those provisions.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through an in-game notification, a pop-up upon launching the Game, or by other reasonable means. The updated Terms will include a new effective date. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree with the changes, you should discontinue use of the Service.

19. General Provisions

These Terms are effective as of March 16, 2026 and supersede all prior versions of any terms of service or end-user license agreement for the Game. By continuing to use the Service on or after this date, you agree to be bound by these Terms going forward. These Terms do not apply retroactively to any disputes or claims arising from conduct that occurred before the effective date.

If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision at any time does not constitute a waiver of that right or provision.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and GMI Studios regarding the Service and supersede all prior or contemporaneous agreements, representations, or understandings. These Terms may not be assigned or transferred by you without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Sections 5 (Virtual Items), 6.2 (License You Grant Us), 6.3 (Feedback), 8 (Intellectual Property), 13 (Disclaimers), 14 (Limitation of Liability), 15 (Indemnification), 16 (Governing Law and Dispute Resolution, including the Class Action Waiver, Jury Trial Waiver, and Time Limitation on Claims), and this Section 19 shall survive any termination or expiration of these Terms.
